Suvendu Adhikari Challenges West Bengal Assembly Speaker's Ban on Central Security Forces in Calcutta High Court

BJP leader and Leader of the Opposition in West Bengal, Suvendu Adhikari, along with the party’s Chief Whip, has approached the Calcutta High Court challenging a recent notification issued by the Speaker of the West Bengal Legislative Assembly. The notification prohibits the entry of central security forces into the Assembly premises following an incident involving the alleged assault of journalists by central security personnel.

The controversy stems from an incident that took place on 6th May on the porch of the Assembly building. During that time, a few journalists were conducting an interview with a Member of the House. It was reported that these journalists were manhandled and assaulted by members of the central security forces stationed at the premises.

Following this incident, the journalists reportedly submitted a letter of complaint to the Speaker of the Assembly. Acting on the complaint, the Speaker issued a notification banning the entry of central security personnel into the Assembly premises.

"The Speaker issued a notification restricting the entry of central security forces into the house premises in response to the complaint submitted by journalists regarding the conduct of central security personnel," as stated in court.

Representing the petitioners, Senior Counsel argued before the Calcutta High Court that this notification unfairly affects BJP legislators who are provided with central security cover. It was pointed out that while MLAs from the ruling party continue to receive security support from state police, the BJP MLAs, under the Speaker’s new directive, are left without any security within the Assembly premises.

This notification directly impacts only BJP MLAs, stripping them of security within the Assembly while legislators from the ruling party continue to be guarded by state security forces, the Counsel submitted.

The petition also highlighted that Suvendu Adhikari, being the Leader of the Opposition, faces specific threat perceptions, and denying him and other BJP legislators their designated central security coverage inside the Assembly is unjust and discriminatory.

"Given the nature of the threats faced by the Leader of the Opposition, security coverage is not merely a privilege but a necessity. The notification creates a discriminatory situation between BJP and ruling party MLAs," the Counsel further argued.

As a result, the petitioners have urged the court to intervene and allow central security personnel to accompany BJP legislators within the Assembly premises, ensuring their safety and maintaining political parity.

Justice Amrita Sinha, after hearing the submissions, scheduled the matter for further consideration on a later date.
