Supreme Court Modifies Bail Conditions for UP MLA Abbas Ansari in Gangsters Act Case

In a significant development, the Supreme Court has modified the interim bail conditions of Uttar Pradesh MLA Abbas Ansari, allowing him to stay at his residence in Ghazipur for up to three nights whenever he visits his constituency, Mau.

While hearing Abbas Ansari's bail plea in a case under the Uttar Pradesh Gangsters and Anti-Social Activities (Prevention) Act, 1986, the Supreme Court modified its previous order dated March 7. The earlier order restricted Ansari to his official residence in Lucknow, with visits to Mau allowed only after prior intimation to the Trial Court and district police.

"Having regard to difficulties being experienced by petitioner (Ansari) while visiting his constituency, clause 2, para 6 of order dt. 7 March is modified to the limited extent that when petitioner visits his constituency, he may stay in the night at his residence in Ghazipur. But such stay will not be for the purpose of any public meeting at the residence. Such stay of the petitioner at Ghazipur shall not exceed 3 nights (initially)," the Court stated.

During the hearing, Senior Advocate Kapil Sibal, representing Ansari, highlighted that the MLA had faced difficulties traveling from Lucknow to Mau due to the distance of over 300 kilometers. Sibal argued that requiring Ansari to return to Lucknow on the same day was unreasonable.

The bench, comprising Justices Surya Kant and N. Kotiswar Singh, acknowledged the challenges faced by Ansari and agreed to modify the conditions. However, the Court maintained that the stay at Ghazipur should not exceed three nights initially and should not be used for public meetings.

Case Background

Abbas Ansari, an MLA from Mau, is facing charges under the UP Gangsters and Anti-Social Activities (Prevention) Act, 1986. An FIR was registered against him and others at PS Kotwali Karvi, District Chitrakoot, for allegedly forming a gang involved in illegal activities, including intimidation, assault, and extortion.

Ansari's initial bail plea was rejected by the High Court in December 2024, citing his leadership role in the alleged gang and the pending investigation. He then approached the Supreme Court, which granted him interim bail in March 2025, but with stringent conditions.
