Punjab & Haryana High Court Directs Woman To File Corruption Complaint Against Sessions Judge With Registry, Not Court

The Punjab and Haryana High Court recently declined to entertain a petition seeking registration of a corruption FIR against a Sessions Judge on the judicial side. Instead, the Court advised the petitioner to submit her complaint with the High Court Registry.

A Division Bench comprising Chief Justice Sheel Nagu and Justice Sumeet Goel was hearing the matter when the petitioner, appearing in person, alleged serious misconduct by a Sessions Judge in a pending case. She claimed that the Judge had issued a "fake order without assigning any case number" and further alleged that he was accepting bribes from advocates to issue favourable decisions.

However, the Bench made it clear that such issues cannot be dealt with judicially, stating:

"Certain acts of corruption and illegality cannot be taken at judicial side."

The Court advised her to file a formal complaint with the High Court Registry and added:

"The petitioner is directed to file the complaint in the Registry which, if filed within 30 days, shall be considered by the administrative side."

The judges also gave an oral assurance that if any substance is found in her allegations, appropriate action will be taken. The petitioner was further directed to include all her grievances along with an affidavit while filing the complaint.

This clarification from the Court highlights the procedural distinction between the judicial and administrative functions of the judiciary. Matters involving complaints against judicial officers must be handled through administrative channels rather than through court proceedings.

In light of the above, the plea was disposed of.
