Murshidabad Violence: Supreme Court Rejects Plea for SIT/CBI Probe, Directs Petitioner to Approach Calcutta High Court Online

The Supreme Court of India has refused to entertain a writ petition seeking an investigation by the Central Bureau of Investigation (CBI) or a Special Investigation Team (SIT) into the recent incidents of violence at Murshidabad, West Bengal. The petition, filed under Article 32 of the Constitution, was dismissed on the grounds that the petitioner has an alternative, efficacious remedy of approaching the Calcutta High Court under Article 226.

A bench comprising Justices Surya Kant and N. Kotiswar Singh emphasized the importance of the High Court's jurisdiction in such matters. The Court stated:

"We see no reason to entertain the petition filed before this Court under Article 32 of the Constitution, as the petitioner has an alternate, efficacious remedy to approach the High Court under Article 226 of the Constitution."

The Court acknowledged the petitioner’s concerns regarding threats to his life and liberty. It, therefore, allowed the petitioner to file the case online before the Calcutta High Court and directed that the hearing could take place via video conferencing.

The Supreme Court instructed the Registrar General of the Calcutta High Court to provide the necessary facilities for the petitioner to file and argue the case online. This decision was taken considering the alleged threat perception faced by the petitioner and his counsels in related matters.

Justice Surya Kant, while disposing of the case, highlighted the inappropriate practice of filing writ petitions directly before the Supreme Court bypassing the High Court’s jurisdiction under Article 226. The bench remarked:

"What prevents you from going to the High Court - a constitutional Court having powers better than the Supreme Court under Article 32...this practice of filing direct writ petitions before the Supreme Court, we will deal with very seriously."

The petition was filed by Satish Kumar Aggarwal, represented by a team of advocates, including Anantha Narayana M.G. and Barun Kumar Sinha. The petitioner sought an investigation into the alleged violence targeting Hindu locals in Murshidabad between April 8 and 12, 2025. The petitioner had requested a probe either by an SIT headed by a retired Supreme Court judge or by the CBI.

After hearing the petitioner’s counsel, the Supreme Court made it clear that the petitioner should first explore remedies available at the High Court level. The bench also criticized any attempt to exaggerate the situation, stating:

"This is all hype being created, we know everything."
