The Delhi High Court has issued a temporary injunction in favour of Agarwal Packers and Movers Ltd. in a trademark infringement case. The case was filed against a fraudulent website—aggarwalmoverspackers.in—which was using a deceptively similar name and services, misleading customers and damaging the company’s goodwill.
Agarwal Packers and Movers, a well-known logistics firm, claimed that the defendant was not only infringing on their registered trademark but also attempting to pass off their services as those of the original company. The plaintiff has been in the business since 1986 and is recognized for its wide range of logistics, relocation, and warehousing services both in India and internationally.
"Due to its widespread goodwill acquired over more than 35 years, the members of trade and public associate 'Agarwal Packers & Movers' solely with the plaintiffs." – Court Order
The court reviewed that the infringing website operated under the name ‘Aggarwal Cargo Packers and Movers’ and was using nearly identical domain names and marks. Justice Amit Bansal observed that such use was likely to cause market confusion and was a clear attempt to exploit the reputation of the original company.

“A prima facie case of infringement and passing off is made out. The impugned marks are virtually identical with the plaintiffs’ marks.” – Justice Amit Bansal
The Court ruled in favour of Agarwal Packers and restrained the defendants, including their agents and associates, from using, advertising, or selling any products or services under the misleading domain or trademark. The domain name registrar was directed to suspend the domain, and telecom operators were instructed to block related phone numbers and UPI IDs.

This injunction not only protects the brand identity of Agarwal Packers but also safeguards consumers from falling into fraudulent traps online.
